1Introduction

This Privacy Policy explains how AskKEMP.ai Limited ("We", "Us", or "Our") collects, uses, and discloses your Personal Data in connection with your use of the AskKEMP.ai platform (the "Platform").

We are committed to protecting your privacy in accordance with the Hong Kong Personal Data (Privacy) Ordinance (Cap. 486) ("PDPO") and other applicable data protection laws, including the United Kingdom and European General Data Protection Regulation ("GDPR").

This policy applies to all users of Our Platform ("You" or "User"), regardless of their location. We are dedicated to providing you with the data protection rights afforded to you under your local laws.

2Personal Data We Collect

For the purposes of this Policy, "Personal Data" means any information that relates to an identified or identifiable individual, in accordance with applicable data protection laws.

We collect the following categories of Personal Data:

(a)
Account and Contact Data: Your name, email address, and physical address.
(b)
Financial Data: Payment card details and billing address. Please note that this information is collected and processed directly by our third-party payment processors and is not stored by Us.
(c)
Usage Data: Information relating to your use of the Platform, specifically the volume of tokens consumed.
(d)
Technical Data: Your IP address, browser type and version, and other technology on the devices you use to access the Platform.

3User-Generated Content and Platform Data

We have designed the Platform to minimise the retention of your sensitive information. It is crucial to understand how different types of data you provide are handled:

(a) User Inputs and AI Outputs

The substance of your queries ("User Inputs") and the responses generated by the Platform ("AI Outputs") are passed to our third-party Large Language Model (LLM) providers for processing. We do not store the content of your User Inputs or AI Outputs on Our systems after your session is complete. We rely on the privacy and security policies of our chosen LLM providers to govern the data whilst it is being processed.

(b) Chat History

You may have the option to store your chat history. This history is stored exclusively in the local storage of your own web browser. We do not have access to, nor do We store, this information on Our servers.

If you choose to upload documents to create a persistent knowledge base, this data is stored in a vector database hosted by Us. This storage is segregated by user, meaning other users cannot access your data. However, for the purposes of system maintenance, security, and service provision, authorised personnel of AskKEMP.ai may have access to this database. If you do not wish for your data to be accessible to Our personnel, you should delete the data from your knowledge base after each use.

(d) Temporary File Uploads

To enable certain functionalities, you may upload files to the Platform. This data is stored temporarily in a SQL database. This data is accessible by authorised AskKEMP.ai personnel for maintenance and support purposes. All data in this temporary storage is automatically and permanently deleted every two (2) hours. If you do not wish for your data to be temporarily accessible to Our personnel, you should delete the file immediately after your intended use is complete.

(e) System Logs

We maintain logs of system activity for a period of thirty (30) days for the sole purposes of troubleshooting, security, and platform maintenance. These logs contain metadata and do not contain the substantive content of your User Inputs or AI Outputs. These logs are strictly confidential and are not shared with any third parties.

4Lawful Basis for Processing (For UK/EEA Users)

If you are located in the United Kingdom or European Economic Area, We are required to identify a lawful basis for processing your Personal Data. We rely on the following:

(a) Performance of a Contract

We process your Account and Contact Data, Financial Data, and Usage Data to create and manage your account, process subscription payments, and provide the Platform's services to you under our Beta Test Disclaimer & Terms of Service.

(b) Legitimate Interests

We process Technical Data and System Logs to maintain the security, integrity, and functionality of our Platform. We also rely on legitimate interests when Our authorised personnel access User Knowledge Base data or Temporary File Uploads for essential maintenance. We will only do so where Our legitimate interests are not overridden by your data protection rights.

Should We wish to send you direct marketing communications in the future, We will only do so with your explicit prior consent.

5How We Use Your Personal Data

We use your Personal Data for the following purposes:

(a)To register you as a new user and manage your account.
(b)To provide, operate, and maintain the Platform and its services.
(c)To process your payments via Our third-party payment providers.
(d)To communicate with you regarding your account, including sending service-related announcements and responding to your enquiries.
(e)To comply with our legal, regulatory, and professional obligations.

6Disclosure of Your Personal Data

We do not sell your Personal Data.

We may share your Personal Data with the following categories of third parties:

(a) Third-Party Service Providers

Such as payment processors and cloud hosting providers who are necessary for the provision of the Platform.

(b) Third-Party AI Platforms

We disclose your User Input to these platforms for the sole purpose of generating the AI Output for you. We are not involved in and do not benefit from any subsequent use of this data by the LLM provider.

Including lawyers, auditors, and regulators where We are required to do so by law or to protect Our rights.

We take care to ensure that any third party with whom We share your Personal Data is contractually bound to protect it and use it only for the purposes for which it was disclosed.

7International Data Transfers

We are based in Hong Kong. When you use our Platform, your Personal Data is collected in your country and transferred to Hong Kong for processing. Furthermore, your User Input is transferred to our Third-Party LLM providers, who may be located in other jurisdictions (such as the United States).

For users in the UK and EEA, such transfers outside of your jurisdiction require Us to have appropriate safeguards in place. For transfers to jurisdictions not deemed to have an adequate level of data protection, We rely on Standard Contractual Clauses as approved by the relevant authorities to ensure your Personal Data is protected to a standard equivalent to that within the UK/EEA.

8Data Security & Retention

We have implemented appropriate technical and organisational security measures to protect the Personal Data We store (such as your Account and Contact Data) from accidental loss, unauthorised access, alteration, or disclosure.

We retain your Personal Data according to the following schedule:

Account and Contact Data:Duration of subscription + reasonable period thereafter

User Knowledge Base:As long as you choose to keep it (deletable anytime)

Temporary File Uploads:Automatically deleted every 2 hours

System Logs:Retained for 30 days

User Inputs, AI Outputs, Chat History:Not retained by Us

9Your Legal Rights

Depending on your location, you may have the following rights in relation to your Personal Data:

(a) Right of Access

The right to be provided with a copy of your Personal Data.

(b) Right to Rectification

The right to require Us to correct any mistakes in your Personal Data.

The right to require Us to delete your Personal Data in certain situations ("Right to be Forgotten").

(d) Right to Restrict Processing

The right to require Us to restrict the processing of your Personal Data in certain circumstances.

(e) Right to Data Portability

The right to receive your Personal Data in a structured, commonly used and machine-readable format.

(f) Right to Object

The right to object to our processing of your Personal Data in certain situations.
